3. Remote Support
We use ConnectWise ScreenConnect for remote sessions. Key conditions:
- Sessions are encrypted and require client authorization.
- Sessions are not recorded.
- Access is terminated once service is complete.
- We cannot and do not access devices without explicit client consent.
4. How We Use Your Information
- To deliver managed IT, security, cloud, and marketing services.
- To troubleshoot and resolve incidents.
- To provide audits, compliance reports, and service records.
- To improve website experience and marketing effectiveness.
- To communicate with clients about services, billing, and updates.
5. Data Sharing
We do not sell or share your data with third parties for marketing. Information may be shared only with:
- Trusted vendors (e.g., Microsoft, Axcient, Sophos, SentinelOne, ConnectWise) for service delivery.
- Regulatory or legal authorities when required by law.
6. Data Retention
We retain service and business records only as long as necessary for service fulfillment, legal compliance, or dispute resolution. Clients may request deletion of their data, subject to regulatory and contractual obligations.
7. Client Responsibilities
- Maintain strong passwords and secure authentication methods.
- Keep devices updated with security patches and antivirus.
- Report suspected unauthorized access promptly.
- Ensure compliance with laws when storing sensitive data on devices.
8. Payment & Billing
Unless otherwise agreed in writing:
- Services are billed monthly, project-based, or hourly.
- Invoices are due within [15/30] days of issue.
- Late payments may incur interest charges.
- Licensing fees (e.g., Microsoft, Axcient, Sophos) are billed separately.
9. Service Limitations
We provide services on a best-effort basis. We do not guarantee:
- Uninterrupted or error-free service.
- Prevention of all cybersecurity threats.
- Recovery of 100% of data in every incident.
10. Third-Party Services
Our services often rely on third-party providers (e.g., Microsoft, Google, Axcient, Sophos). Their outages, failures, or breaches are outside of our control. Use of third-party services is subject to their respective terms and conditions.
11. Confidentiality
We treat client information as confidential and do not disclose it without consent, except when legally required. However, clients acknowledge that electronic communications and cloud services carry inherent risks outside our control.
12. Security Measures
We use industry-standard safeguards (encryption, firewalls, monitoring, access controls). Still, no system is 100% secure. CypherSwway is not responsible for:
- Pre-existing malware or vulnerabilities on client devices.
- Client negligence in securing systems or data.
- Third-party breaches or vendor failures.
- Incidents outside our direct control.
13. Limitation of Liability
To the fullest extent permitted by law, CypherSwway Inc. is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services or website. Our liability is limited strictly to the fees paid for the specific service giving rise to the claim.
14. Termination of Services
We may suspend or terminate services if:
- Invoices remain unpaid.
- Client engages in illegal, abusive, or fraudulent use of services.
- Service continuation poses a security or compliance risk.
15. Governing Law
This agreement is governed by the laws of British Columbia, Canada. Disputes will be resolved exclusively in the courts of British Columbia.
16. Updates to Policy & Terms
We may update this policy from time to time to reflect service changes, compliance requirements, or legal updates. Updates will be posted on this page with a revised effective date.
